Legal Aid to Scheduled Castes and Vimukat Jatis Scheme

The “Legal Aid to Scheduled Castes and Vimukat Jatis Scheme” is a vital initiative by the Haryana government aimed at providing legal support to the marginalized communities within the state. Launched on February 13, 1961, by the Department of Welfare of Scheduled Castes and Backward Classes, this scheme addresses various legal challenges faced by Scheduled Castes and Vimukat Jatis. The government facilitates a cost-sharing model where both the Government of India and the State Government contribute equally.

Overview of the Scheme

This scheme is designed to offer legal assistance to members of Scheduled Castes and Vimukat Jatis for defending or initiating specific types of legal cases. The following categories of cases are covered under this legal aid:

  • Criminal cases initiated on private complaints, including security proceedings under Chapter VIII of the Code of Criminal Procedure, 1898.
  • Cases involving eviction from land or other immovable properties.
  • Disputes related to the recovery of rent by landlords.
  • Issues concerning Khasra Girdawaris.
  • Cases for the deposit of rent with Revenue Officers when a landlord refuses to accept rent or provide a receipt.
  • Disputes regarding corrections in Khasra Girdawaris by landlords.
  • Claims related to the right of way usage.
  • Cases involving the forcible removal of dung heaps.
  • Claims for compensation due to harassment from the denial of basic rights, such as drinking water or temple entry due to untouchability.
  • Disputes over agricultural produce shares among Siri, Sanjhies, or Seepidars.
  • Claims for damages under tort law by the families of women who have been abducted or enticed away.
  • Cases concerning reservations in services filed by Scheduled Castes, Vimukat Jatis, or Tapriwas employees.

As part of the scheme, any member of the Scheduled Castes or Vimukat Jatis receiving legal aid must enter into a written agreement. This agreement stipulates that any compensation, damages, or costs recovered from the opposing party will be reimbursed to the government to cover the costs incurred by it, with only the remaining balance retained by the individual.
